Colin B. Picker Prize honors Ernesto Vargas Weil with an honorable mention

With honorable mention in the Colin B. Picker Prize, the work presented by our partner Ernesto Vargas Weil at the annual conference of the Young Comparative Committee (YCC) of the American Society of Comparative Law was distinguished. The recognition is given to the best paper presented by a graduate student at the YCC Annual Global Conference, which this year was held remotely on October 23. The honorable mention was awarded by the Committee of Young Comparativists of the American Society of Comparative Law.

His work deals with "The numerus clausus as a constitutional norm of property rights: a macro-comparative approach" and in it, he analyzes the principle of numerus clausus from the perspective of its impact on the role of the courts, legislators and the style of legal reasoning in modern Germany, England, and the United States. In the work, it is concluded that the principle of numerus clausus has notoriously different "systemic effects" in each jurisdiction and that this has relevant implications for the justification of the principle, calling into question some established conceptions about the differences and similarities between the right to property civil tradition and common law.

This article is part of the doctoral research that Ernesto is carrying out at University College London, entitled: "Stability and change in property law: a comparative approach to the numerus clausus principle", supervised by Professor Ben McFarlane.
