In its 161st edition, the magazine of the Center for Public Studies (CEP) publishes the article "Property versus the blank page: constitutional tradition and comparative law" by our partner Ernesto Vargas Weil. Motivated by the national agreement reached in 2019 in Chile, the essay analyzes the constitutional history of our country and comparative law to identify possible topics on which the discussion around the protection of property in the new constitution could focus. The article suggests that the debate on the matter should focus on a few issues that are not part of the Chilean constitutional tradition and do not have uniform treatment in comparative law, such as the status of waters, indigenous property, and legal limitations with legal effects. expropriation.
