In their article "Conceptual bases for the doctrine of the professional secret of the lawyer in Chile", our partners Alvaro Anríquez Novoa and Ernesto Vargas Weil propose conceptual bases to dogmatically characterize the professional secret of the lawyer in Chile. The essay was published in Vol. 48 No. 1 (2021) of the Chilean Law Review, edited by the Law School of the Pontifical Catholic University of Chile and in it, the authors point out that it is necessary to distinguish professional secrecy from duty of confidentiality of the lawyer, by way of considering the first as a procedural immunity that makes the second operational, against a request for information by the State. They conclude that to the extent that immunity collides with the State's interest in accessing the facts necessary for the exercise of jurisdiction, its scope of application must be less than that of the duty of confidentiality.
